The following terms and conditions pertain to each design job we perform; these terms and conditions serve as an agreement between J & L Designers and you, the customer. Before receiving artwork from J & L Designers, customers are required to express agreement with the following terms and conditions.
Ownership of Artwork
All logos and graphic design elements (referred to as artwork in these terms and conditions) created by J & L Designers are the property of J & L Designers until the artwork has been purchased, at which point the artwork becomes property of the purchaser (referred to as the Customer in these terms and conditions).
The Customer automatically grants permission to J & L Designers to showcase their artwork, created by J & L Designers, on the jldesigners.com website for sampling purposes only. It is understood that no artwork displayed on the jldesigners.com website can be used for any other purpose, by any individual or company except the purchaser of the logo and/or the party/parties given permission by the purchaser to use the logo.
Declined Artwork Design Requests
J & L Designers retains the right to refuse any artwork design request for any reason, and at any time prior to receiving payment for the artwork design request. However, if the request is declined after payment is conceded to J & L Designers, the Customer is entitled to and will receive full reimbursement for their payment. Artwork design requests are typically declined when they involve creating artwork that promotes or conveys criminal activity, adult entertainment, or any services or acitivities that could be considered morally indecent or questionable.
Artwork Modifications
When providing any unlimited artwork modifications as part of any custom logo design package, J & L Designers retains the right to decide if artwork redesign requests made by the Customer ever become unreasonable or unreasonably excessive, though J & L Designers stands behind its LogoApproval Guarantee. Artwork modification requests that are labeled by J & L Designers as unreasonable or unreasonably excessive are subject to delay in being carried out, refusal of being carried out, or incurrence of additional charges.
Changes considered by J & L Designers to be major changes, which are requested by the Customer to be made to any artwork developed by J & L Designers, will not be classified as a modification, but rather as an additional concept.
There is typically an additional charge to make changes to a custom logo after LogoApproval if such changes are requested. J & L Designers is not obligated to make changes to any artwork in a custom logo design package, free of charge, once complete satisfaction with all artwork in the package has been expressed by the customer.
Final Artwork Release and Usage
Final artwork which comprises any logo design package will not be released to the Customer until full payment for the package has been received by J & L Designers. The only exception shall be in the case of the Customer requesting to have sent to him/her the final logo before all other accompanying artwork is finalized; this exception does not apply to the Autumn Package.
J & L Designers is not responsible for payments claimed to be lost by mail, sent to the wrong address, or otherwise not received by J & L Designers. Cases such as these will be resolved on an individual basis. J & L Designers has no incentive or desire to withhold artwork from the Customer after receiving full payment for the artwork—all final artwork will be remitted to the Customer immediately after full payment is received by J & L Designers and after the Customer has expressed his/her satisfaction with all artwork.
The Customer understands that final artwork that is provided to the Customer by email or as a free download is often zipped/compressed, therefore the Customer, when only receiving final artwork through the internet, and not by mail on CD, will need to have on their computer a file decompression program, such as WinZip or StuffIt Expander in order to open finalized artwork. J & L Designers is not responsible for any delays that may arise due to the Customer's inability to use final artwork as a result of file decompression issues.
Artwork Design Procedures
Artwork design procedures listed on the jldesigners.com website will be followed as closely as possible, though there may be cases in which procedures must be slightly modified, or design services must be delayed. J & L Designers is in no way responsible for customer-end unmet deadlines for any reason.
Pricing
The Customer agrees to pay the current price (price at the time of their order) specified on the jldesigners.com website for any artwork they intend to receive. Any payment received by J & L Designers from the Customer that is deemed as invalid for any reason will not be exchanged for final artwork. The Customer agrees to provide valid payment to be exchanged for final artwork.
Legal Remedy
The Customer agrees to settle any and all disputes which may arise during or after the artwork design process, between the Customer and J & L Designers, outside of court. The Customer shall, in good faith, hold J & L Designers blameless for all perceived or obvious errors, delays, miscommunication, or any failure on the part of J & L Designers in providing flawless service to the Customer, and shall not bring lawsuit against J & L Designers for any reason.
Printing
The Customer understands that all final artwork developed by J & L Designers is provided solely in digital format. This means J & L Designers does not provide any printed artwork, such as printed business cards, stationery, or brochures. All final artwork provided by J & L Designers is, instead, printer-ready, meaning it can be taken, as is, to a commercial printer by the Customer to be quickly and easily printed on the stock and in the quantity of choice, typically with no need for any further file formatting.
After Payment
J & L Designers is indeed responsible for sending artwork, for which valid payment has been received, to the Customer. Once this artwork has been received by the Customer, however, J & L Designers is no longer responsible for the artwork, though J & L Designers stands behind its J & L Storage system.
Conclusion
The Customer agrees and is encouraged to ask questions, regarding any section or sections of these terms and conditions that he/she does not understand, before ordering any type or any amount of artwork from J & L Designers. |
